You need to identify WHO this person is ASAP as he is seriously putting off potential buyers. As someone has suggested.. Get video evidence if this occurs again, this is proof of whats happenning...legal advice costs $$ so use this as last resort.

Have you thought about getting someone (the agent) to ask them what their problem is? Maybe they are worried you will sell and sub divide or something like that.

Good morning, Yesterday I was told by my Real estate agent that someone has been standing outside (twice) my house during the open house and saying that my house needs too much doing to it and being negative about it.
I am in Victoria and just want to know the laws on this.
This person has not been one of two who has had a building inspection and is not in a position of authority to say these things. (Wanting a cheaper house?)

The only precedent I can think of is the people who stood outside of McDonalds handing out leaflets saying that McDonalds' food was bad for you. As I remember it, the only thing McDonalds could do about it was sue them for defamation based on the contents of the leaflets - i.e. it seems it is perfectly legal for someone to stand on the footpath telling people things you don't want them to be told.
If I was the agent I would tell people that the person outside was spouting rubbish because they had already made a low offer and were trying to stop other people from making a competing offer, and if necessary back up the claims that it was crap by handing out copies of a building report and inviting them to make their own judgement based on hard facts rather than the opinion of a stranger with a vested interest in it not selling because they thought it was good enough to make an offer.
You can't necessarily stop someone from being an arsehole, but there is no law against trying to turn it to your advantage.

In both cases you have someone in the public space approaching people other than you with intent to prejudice legitimate business being conducted in the private space.
Maybe you could hire a very expensive lawyer to prove that there is a difference between the two scenarios, but that wouldn't help you much. Or you could be like a nightclub and hire bouncers to harass the harassers right back I guess.

I was thinking it might qualify for tortious interference, but the person has to actually prevent trade or a contract for that. Other than that, public nuisance, harassment ....
