Not adequately. You have rambled incessantly about the protections offered to the title owner and the measures to protect fraud.
You have stated that if defrauded the original title owner has their ownership restored.
You are unable to provide a single case whereby this has occurred.
Yet we have a case where a lady has been defrauded in Canberra. And I ask a simple question you refuse to answer.
Did she get her house back or not?
Like I said previously when Trolley was wrongly claiming she got nothing, not even compensation; she didn't have custody or control of her Certificate of Title.
But tell me, do you truly believe that a person can lose ownership of their home of 30, 50, or even 70 years to another person simply because they are a victim of fraud?

She was the victim of Identity Theft. She lost control of more than her CT. Are you so naïve to believe that this cannot happen to you? You seem to think in the same circumstance you would get your house back. Did she get her house back?

That lady in Canberra. She was a victim of fraud. Did she get her house back after the fraud was uncovered?
Quote:
Why do you believe this?
Why do you believe you would be treated differently under law than the lady in Canberra? That lady - did she get her house back as you think you would, or was the outcome for her different? If she couldn't get her house back why do you think in the same circumstance you would benefit differently? Why do you believe this?
My only hope for my three boys is that they turn out nothing at all like Chris.

"A woman whose house and identity was stolen by overseas scammers has been forced to sue the government to retrieve her money... The fraud stripped the victim of any right to the property, which was legally transferred to the innocent couple who bought the house... Registered real estate purchases made in good faith are protected by the ACT Land Titles Act... Even though her home was sold without her knowledge, the woman is not entitled to reclaim it"
When the home is sold fraudulently to an innocent new buyer, then the new buyer has indefeasible title. That's what the principle of indefeasibility is all about.
Waving around the old printout of your title won't get your house back, because your printout no longer matches the register.
At best you can go to court and cross your fingers hoping for some compensation.
"Property scams continue in Perth Mr Mildenhall can "apply to Landgate for a claim of the value of the property and the costs incurred in making that claim, or begin lengthy legal proceedings" for compensation."
I'll say it again Golly. When your home is sold fraudulently to an innocent buyer, you WILL NOT get the property back. It's gone. The new title is indefeasible.

Again, she didn't have her Certificate of Title.
Her solicitor handed it over to the scammers.
Show me a case of where a fraud like this has occurred where the owner has retained possession of their Certificate of Title.

The article doesn't say whether Mr Mildenhall had his printout, but it doesn't matter anyway. If the printout is stolen or counterfeited or a duplicate is printed then the property can be sold, the new buyer has indefeasible title, and the old printout is worthless. It doesn't matter if you 'retain possession of your printout' because that printout is worthless once the property has been sold to somebody else.

Are you being ignorant or are you truly this clueless.
If I steal your identity, and produce myself to the titles office masquerading as you, claim I cannot locate my title, fill in the paperwork, pay the fee, have a new CT issued then I can sell your house.
You have massive faith in the fact that nobody will steal your title physically. They don't need to. All they need to do is steal your identity.
This is what happened to the Canberra woman. Once she lost her house to the identity thieves did she get it back as you claim you would or not?
My only hope for my three boys is that they turn out nothing at all like Chris.

Silly Golly seems to think because the Canberra woman had her printout stolen via her solicitor, this is somehow different to having it stolen directly, or counterfeited, or superseded by a new one. Either way the outcome is the same - the home can be sold, the new buyer has indefeasible title, and Golly is left frantically waving a worthless sheet of paper around and wondering what the hell happened.

Won't people be interested too know how worthless and transient their home ownership is.
$1,200,000 and whoosh, can be taken away from you just like that!
I like the scams where people come in and pay off the last few thousand dollars to the bank, then acquire title and flog the place.
